What the law does
New York's FY2026 budget (S 3008 / A 3008) requires operators of AI companions offered in the state to maintain a protocol that detects suicidal ideation or self-harm and refers users to crisis services. Operators must give a clear notice that the user is not talking to a human at the start of an interaction and at least every three hours during continuous use. The Attorney General may seek penalties of up to $15,000 per day. The AI companion sections took effect November 5, 2025.
