Automated decision systems in utilization review

What the law does
Texas SB 815 adds Insurance Code section 4201.156. A utilization review agent may not use an automated decision system, including AI, to make an adverse determination in whole or in part. Algorithms remain allowed for administrative support and fraud detection. The Insurance Commissioner may audit tool use. The statute took effect September 1, 2025, and applies to plans delivered or renewed on or after January 1, 2026.
